Thanks for using Nyxe. By accessing or using our app, you agree to these terms. If you don’t agree, do not use Nyxe.
1. Your account
You must be at least 13 years old. Keep your credentials secure and only use accounts you are allowed to use. You are responsible for activity on your account.
2. What Nyxe provides
Nyxe helps you create, edit, and test HTML email templates using AI and a visual editor. We may offer free and paid plans with usage limits (for example, credits, rate limits, or feature caps). See our Pricing page for current limits.
3. Acceptable use
- No spam, phishing, scams, or illegal content.
- No malware, harmful code, or attempts to disrupt our service.
- Only send test emails to addresses you control or have permission to contact.
- Respect third‑party rights (copyright, trademarks, privacy, etc.).
4. Your content
You own the templates, prompts, and assets you upload or create in Nyxe. You grant us a worldwide, non‑exclusive license to host, process, render, and display that content only to operate Nyxe (for example, to generate previews, send test emails, and maintain backups).
5. AI outputs
AI can be wrong or incomplete. Review outputs before use. You are responsible for the emails you send and the claims you make in them.
6. Third‑party services
We rely on providers such as payment processors (e.g., Stripe), email delivery (e.g., a transactional email service), and AI APIs to run Nyxe. Your use of those features may be subject to their terms and policies.
7. Billing
Paid plans are billed in advance and auto‑renew until canceled. You can cancel at any time; access continues until the end of the billing period. Fees are non‑refundable except where required by law.
8. Fair use and limits
To protect the service, we may throttle, rate‑limit, or suspend accounts that exceed fair use or abuse the platform.
9. Termination
We may suspend or end access if these terms are violated or to protect the service. You may stop using Nyxe at any time.
10. Disclaimers and liability
Nyxe is provided “as is” without warranties. To the fullest extent permitted by law, we are not liable for lost profits, revenues, or indirect damages. Our total liability for any claim is limited to the amount you paid to us in the 3 months before the claim arose.
11. Changes
We may update these terms by posting a new version here. If you keep using Nyxe after changes take effect, you accept the updated terms.
